I am aware of and expressly assume all risks (known and unknown) associated with attending the Scrubs in the City event being held at Evergreen Brick Works on June 4, 2026 (the “Event”). I, on behalf of myself and my personal representatives, assigns, heirs and next-of-kin, hereby waive, release and forever discharge The Hospital for Sick Children Foundation (the “Foundation”), The Hospital For Sick Children (the “Hospital”), any beneficiaries, sponsors, advertisers, consultants, third-party vendors, and each of their respective affiliates, successors, officers, directors, members, employees, volunteers, agents, and representatives (collectively referred to as the "Releasees"), of and from any and all proceedings, claims, demands, damages, costs, expenses, actions and causes of action (whether known or unknown) whatsoever, both in law and in equity, which I now have or may hereafter have for or by reason of or in respect of attending the Event.

I further agree to hold harmless and fully indemnify the Releasees from any and all actions, causes of actions, claims, damages and demands whatsoever which may be brought against or made upon the Releasees and against all loss, liability, judgements, costs or expenses which the Releasees may sustain, incur or be put to resulting from or arising out of any act or omission on my part or of my guests, agents, successors or assigns which was done, or purported to have been done, in connection with my attendance of the Event.

I agree to conduct myself in a safe manner and to adhere to all federal, provincial, and municipal laws, including without limitation any and all public health guidelines and measures regarding the prevention and mitigation of spreading infectious diseases such as influenza, respiratory syncytial virus (“RSV”) or other viral respiratory infections COVID-19. I agree to drink responsibly and that the Releasees are not responsible or liable for any damages, including but not limited to, property damage, personal injury and death to myself or third parties that result from the consumption of alcohol by myself or others at the Event.

I acknowledge and agree that attending the Event may increase the risk of being exposed to or infected by any influenza, RSV or other viral respiratory infections, including COVID-19 , and any influenza, RSV or other viral respiratory infections, including COVID-19 may result in personal injury, illness (such as fever, cough, sore throat, shortness of breath or difficulty breathing), hospitalization, permanent disability, and death. I, on behalf of myself and any of my guests, voluntarily assume all risks and dangers associated with influenza, RSV or other viral respiratory infections, including COVID-19 that may result from attending the Event.

The provisions of these Terms, Conditions, Waiver, Release and Indemnity (the “Terms”) shall enure to the benefit of the respective heirs, executors, administrators, personal representatives, successors and assigns of each of the Releasees and shall be binding upon my heirs, executors, administrators and personal representatives. These Terms shall be interpreted and the rights of the parties determined, under the laws of the Province of Ontario and Ontario courts shall have exclusive jurisdiction for any dispute.

The Foundation reserves the right in their sole discretion to, without advance notice, terminate or suspend the Event, in whole or in part, or modify it in any way including without limitation cancelling, postponing, rescheduling or moving the Event to a different date or materially different time or venue. The Foundation is not liable for travel, accommodation, hospitality, or any other expenses

that you or anyone else incurs in connection with the cancellation, postponement, rescheduling, or movement of the Event.

I acknowledge that the Foundation will attempt to inform Event ticket holders if any material changes to the location, date, and/or time. While the Foundation will make reasonable efforts to notify Event ticket holders regarding any changes as soon as the Foundation has the relevant information, the Foundation cannot guarantee that Event ticket holders will be informed of such changes; it is the Event ticket holders’ responsibility to check (1) whether the Event has been canceled, postponed, rescheduled, moved, or otherwise altered, and (2) the location, date, and time of any moved or rescheduled event.

I acknowledge and agree that except as set out in these Terms, all Event ticket fees are non-refundable.

If the Event is cancelled, the Foundation will offer Event ticket holders the option to convert the Event ticket fee to a charitable donation to the Foundation in accordance with the Foundation’s policies and procedures or receive a full refund for the Event ticket fee. Any refunds will be issued to the original method of payment used at time of purchase and refunds will only provide the original purchaser a refund.

If the date of the Event is changed, the Foundation will issue a new ticket to the Event ticket holder for the new Event date or will offer Event ticket holders the opportunity to convert the Event ticket fee to a charitable donation to the Foundation in accordance with the Foundation’s policies and procedures.

The Foundation may permit Event ticket holders to transfer their Event ticket to a different individual, provided that the original Event ticket holder contacts and receives confirmation the Foundation in writing, in advance of the Event of such transferred Event ticket. Once a recipient has accepted an Event ticket transfer, the transfer cannot be cancelled or reversed. If an Event ticket is transferred multiple times, only the Event ticket from the most recent transfer will be valid for entry; all previous tickets will be cancelled. The Foundation reserves the right to cancel transferred tickets at any time if it determines that they were obtained fraudulently.

I understand and acknowledge that I am giving up substantial rights by accepting these Terms. I agree and acknowledge that I am signing these Terms freely and voluntarily, and intend by my agreement to be a complete and unconditional release of all liability against the Releasees to the greatest extent allowed by law. If any portion of this Wavier, Release and Indemnity is held to be invalid, the balance notwithstanding, shall continue in full force and effect.
